1. The agreement

These terms are an agreement between you and Selfmade Ninja Academy (“we”, “us”), a business established in India, for the use of Selfmade Ninja Cloud (“the service”) at https://selfmade.work. You accept them by ticking the agreement box when you create an account, and again by continuing to use the service after a new version takes effect. The version you accepted is recorded on your account together with the date.

You must be at least 18 years old, and if you are acting for an organisation you confirm that you are entitled to bind it. The Acceptable Use Policy, Privacy Policy, Refund Policy and, where it applies to you, the Data Processing Addendum are part of these terms.

2. What the service is

A workspace is a KVM virtual machine on hardware we own in Hyderabad, India. You get root on it, a dedicated public IPv4 address mapped one-to-one to the machine on every port, SSH access, a WireGuard endpoint, domains with TLS certificates, managed databases, snapshots, and an MCP server through which the AI agents you authorise can operate the machine. The Selfmade Ninja Labs platform is installed on it, ready to use.

You administer the machine. What runs inside it — the operating system after first boot, the software, the users, the data — is yours to manage and to secure. We operate the hypervisor, the network, the control plane and this console. Outbound port 25 is closed by default; see the Acceptable Use Policy for why and for how to ask.

3. Your account

  • Give us accurate details and keep them current. We use the email address on the account for every notice these terms require, so an address you no longer read means a notice you never see.
  • Keep your credentials to yourself. Passkeys and time-based one-time codes are available as a second factor; we recommend turning one on. You can see and revoke your sessions from your account settings.
  • Everything done through your account is your responsibility, including what an AI agent does with a token you issued it. Scope tokens narrowly and revoke them when you are done.
  • You may name a security contact — an address we write to if your account is misused or compromised. It can be someone without an account.
  • Tell us at support@selfmade.ninja as soon as you believe your account has been compromised.

4. Acceptable use

You have root on a machine with a public address, so the rules are about what you do to other people’s systems, not about what you do to yours. They are set out in full in the Acceptable Use Policy. In short: no attacks on systems you do not own or have written authorisation to test, no spam, no cryptocurrency mining without our prior consent, no illegal content, and no interference with the platform or other tenants.

5. Fees, billing and tax

  • Prices are published at /pricing and are quoted in Indian rupees. Goods and Services Tax is added at the applicable rate for customers in India. Where we sell to customers outside India, the price list states the currency and any tax that applies.
  • Plans are billed in advance. Usage-based items and add-ons are billed as they accrue. Payments are taken by our payment processor; we do not see your card number.
  • If a payment fails or a prepaid balance runs out, we tell you by email. If it stays unpaid we stop the workspace, and after a further notice we delete it. Deleting a workspace deletes its disk and its snapshots.
  • We may change prices. A change to a plan you are on takes effect no sooner than 30 days after we email you about it, and never within a period you have already paid for.
  • Refunds are governed by the Refund Policy.

6. Your data, snapshots and backups

The contents of your workspace, its managed databases and its snapshots are yours. We do not read them, and we access them only as the Privacy Policy and the Data Processing Addendum describe: at your request, or where the law requires it.

Snapshots are not backups. A snapshot is a point-in-time copy of a disk stored on the same host as the disk. It protects you against a bad change; it does not protect you against the loss of the host. We do not yet keep copies of your data on other hosts or in other locations. Keeping a copy of anything you cannot afford to lose somewhere we do not control is your responsibility.

7. Availability

We make no uptime commitment. There is no service level agreement and there are no service credits. We publish a measured availability record once we have 90 days of one, and we will set a commitment against that record rather than ahead of it. Where maintenance needs a workspace to stop, we tell you by email in advance whenever it is in our power to do so.

8. Suspension and termination

By you. Delete your workspaces and close your account from the console at any time. What we keep afterwards, and for how long, is in the Privacy Policy.

By us. We may suspend a workspace — take it off the network while keeping its disk — or terminate an account when: the Acceptable Use Policy is breached; a payment is overdue after notice; a court, regulator or law of India requires it; or the machine is being used in a way that endangers the platform or other tenants. Except in an emergency, we notify you first and give you time to put it right; the process is described in the Acceptable Use Policy. We may also end the service, or a plan, on 30 days’ notice, in which case any period you have paid for and not used is refunded.

9. Legal compliance and lawful requests

We comply with the law of India and with lawful orders from its courts and authorities. Under the directions issued by CERT-In on 28 April 2022 we keep connection and access logs for 180 days within India, keep the identity details of account holders for five years after an account closes, and report qualifying security incidents to CERT-In within the time the directions require. Where a lawful request concerns your account and we are permitted to tell you, we do.

10. Sanctions and export control

The service is not available to anyone in a country or territory subject to comprehensive sanctions or embargo, or to anyone named on a sanctions list maintained by the United Nations, India, the European Union, the United Kingdom or the United States. You confirm that you are not such a person and that you will not make the service available to one. You will not use the service for any purpose prohibited by export-control law, including the development of weapons. We may close an account without notice to comply with this section.

11. Intellectual property

What you put on your workspace stays yours. The console, the control plane and the Selfmade Ninja Labs platform software stay ours or our licensors’, and you receive the right to use them for the term of the agreement. Lab templates you import remain subject to their own licences. If you send us suggestions we may use them without obligation to you.

12. No warranty

The service is provided as it is and as it is available. To the extent the law allows, we make no warranty that it will be uninterrupted, error-free or fit for a particular purpose. Nothing in these terms excludes a right that the law does not allow to be excluded.

13. Limits on liability

To the extent the law allows, our total liability to you under or in connection with this agreement, in any twelve-month period, is limited to the fees you paid us in that period. We are not liable for loss of profit, loss of data, loss of business or any indirect or consequential loss. Nothing limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law.

14. Your responsibility to us

You will cover us against claims, losses and reasonable costs that arise from your content, your use of the service in breach of these terms, or the acts of anyone — a person or an agent — you have given access to your account.

15. Changes to these terms

Each version of this document carries a date, shown at the top, and that date is what your account records when you accept. For a material change we email account holders at least 30 days before it takes effect; for a correction that does not change your rights we simply update the page. Continuing to use the service after a change takes effect is acceptance of it. If you do not accept a change, close your account before that date.

16. Governing law and disputes

This agreement is governed by the laws of India, courts of Chennai, Tamil Nadu. Before starting any formal proceeding, write to support@selfmade.ninja and give us 30 days to resolve the matter with you; most things are resolved that way.

17. General

  • These terms and the documents they incorporate are the whole agreement between us about the service.
  • You may not transfer this agreement without our consent. We may transfer it to a successor that takes over the service, and we will tell you if we do.
  • If a court finds part of these terms unenforceable, the rest still stands.
  • Neither of us is liable for a failure caused by something outside our reasonable control.
  • Notices to you go to the email address on your account. Notices to us go to support@selfmade.ninja.
  • The English text of this document is the one that binds.
